Why is There a Negotiation / Self-Resolution Stage?

We are able to resolve disputes that landlords and tenants cannot resolve directly. We are able to do this by:


  • Focusing on agreement of the claim amount first, and then resolving tenant payment separately. This means that tenants are put in a position to accept a genuine claim, even if they are unable to pay that amount now.
  • Being an independent third party and mediator. We liaise with both parties to understand their positions and support an agreement being reached.
  • Our system enables a flow of offer and counter-offer, enabling both parties to present a position they would accept and then work from there.


Our claims system builds on the learnings that The Dispute Service have built over the last 18 years. They have found that over 25% of disputes can be resolved at this stage (with more than 50% being resolved without the need for adjudication), and that figure has been continually increasing.
